General sales conditions

The following terms of sale concern the relation between COLIBRI SARL, «easysante» department which will be named «easysante» in this document, and its customer. Both parties accept the terms without reserve. These terms of sale prevail on any other terms included in any document except for written special dispensation.
They are effective in France and all over the world.

* Products :
Our cranberry juice and cranberry concentrate are made of North-American cranberry (vaccinium marcocarpon). All products proposed by «easysante» should be normally available.
In case our customer orders an unavailable product or he/she does not agree on the delivery time, «easysante» will propose to the customer another kind of product in order to replace it and the customer has the right to accept or refuse the suggested solution.

* Price :
The price of each product is displayed on easysante website together with VAT/TAX. Shipping charges are not included and the shipment will not take more than 15 days.

* Protection of the privacy :
Personal information has to be provided in mail-order selling business and this information is necessary to draw the order and the invoice and for the delivery of goods. In case of not provided information, the order will not be effective.
In conformity with the regulations in force, the data processing of all personal information has been declared at the National Commission for Data Processing and Freedom of France (CNIL).

* Controversy and contention :
This contract is subject to the French law. Every objection about its validity, interpretation and carrying out will be submitted to the local jurisdiction.

General provisions

# Retracting
In conformity with the regulations in force, the customer can retract up to 7 days after receipt of goods. If the period expires on saturday, sunday or non-working day, the time limit is extended to the first following working day.
The refused goods have to be returned in their original undamaged package together with their accessories, if there are any.

# Property
"easysante" owns the ordered goods until actual and total payment of the invoice. Anyway, after delivery of goods the customer is responsible for the products.

# Responsibility
"Easysante" is not responsible for damage of every kind, material or intangible damage or injury caused by a bad use of our products.
"easysante" responsibility is limited to the amount of the order but «easysante» cannot be implicated in case of error or omission occurred despite complete information provided in the presentation of products.

However, «easysante» cannot guarantee the absence of modification by a third party (intrusion, viruses) and accept no responsibility in case of error or omission caused by a third party.

Transport – delivery and guarantee

* Delivery
The delivery is carried out by COLISSIMO or by post (for teas and infusions) after receipt and validation of payment. The destination correponds to the address indicated in the order by the customer who undertakes to take delivery of goods.
«easysante» and the customer agree on a delivery time which normally does not exceed 15 days after authorisation payment by payment centres.
Hipothetically the delivery does not have to exceed 30 days from the following day from placement of the order.

* Guarantee
After delivery the customer has 7 days to point out the nonconformity of products to «easysante». «easysante» replaces the product with anotehr one and dispatches the product at the agreed delivery condition and time.
Hipothetically the customer benefits from legal warranty against eviction and latent defect.
Art. 1625 of the French Civil Code.
